We left my friend's apartment about 01h30. A few blocks away I was stopped at a traffic light waiting to make a left turn. The light was for straight ahead only. The light changed to regular green and I was about to make my turn, when I saw the cop car turn on its flashers. Then we got slammed in the rear. We weren't hurt. I stopped my car on the other side of the intersection next to the curb and turned off the engine.

The lady cop came over to see if we were alright. Her partner, also a lady, went to check on the idiot who had rear ended me. A lot of other cop cars came to the intersection. I guess the guy who hit me was drunk, because they had him in handcuffs. I got her and her partner's names and badge numbers and the incident number. I guess I couldn't ask for better witnesses.

We got towed home, about 20 km and emptied the trunk and cabin. Then the tow truck guy drove me to the dealership. I put the key and my biz card in an envelope, put the license number on the outside along with my name and phone number. Put it in the slot provided. The tow truck guy drove me home.

I don't think I'm gonna sleep much tonight. Steve, the tow truck guy, figures the insurance company isn't going to want to repair my car. I'm all in a tizzy. My beautiful car is damaged - by an idiot drunk driver. I'm not going to be able to relax until I've spoken with my insurance company.

And it's income tax season. I don't have time for this now.

Wow, that sucks.

My heart goes out to you.

I remember when Steph was rear ended in our Volvo, the guy hit and ran. The police didn't do much, but Wawanesa came out and took a look at it.

However, because it was a DUI, you might want to call and find out, his insurance might pay. I don't think that they or the government (SAAQ) will give you much grief. If anything, because it was a DUI, it may be even more likely to be fixed.

If you don't get an answer that suits you, maybe contacting an attorney wouldn't be a bad idea. Not to "sue the guy for a million dollars" because I know you can't do that in QC. However, because it is tax season, if there is any substantial problems in getting everything straightened out, he/she/it may be able to at least get that one worry off your head.

Thanks Steve. I am awfully fond of Knud (my Volvo). It was my first nice car.

We've got no fault insurance here, so it will all be taken care of by my insurance company. The fact that I was 100% not-at-fault means that I don't have to pay my deductible. They are covering an equivalent sized rental car, so, hopefully it shouldn't cause too much inconvenience for tax season. Now I'm keeping my fingers crossed that Knud can be fixed. I don't want to have to go car shopping.

The car was a 1995 Volvo in pristine condition, but with over 350,000 KM (about 220,000 Miles) on it. The towtruck guy told us that a rear-ending as bad as we got would probably cost more than the book value of the car to repair, so it will probably be scrapped. Then again, it was clear he doesn't see many damaged Volvo's so he may be wrong.

As [livejournal.com profile] swestrup said, it is a 1995 with high mileage. The trunk was smashed in pretty far and the something was rubbing the rear wheels. When it was towed, he had to put dollies under the rear wheels. I'm sure hoping it can be fixed for less than the book value.

Glad you two are allright. Sorry for poor Knud, though.

The insurance damned well better provide for a replacement car as they do their kerfuffling so you can continue to do your work, though.

I phoned the insurance and they told me I can go ahead and rent a car of similar size to my Volvo and that's covered. The Volvo dealership has Volvos that they rent to you cheap when your car is being worked on, so that's what I'm hoping for. Otherwise, the insurance company uses Enterprise (but I can use anyone) and then I give Enterprise my claim number and the name of the lady I spoke with. I like Enterprise, but they don't have any Volvos.

Big sympathies indeed. I'm glad you're alright, but sorry about Knud; he's a great car and I know I'd be sad to lose him or see him hurt.

Thank you for the sympathy - it helps.

Since we have "no fault" insurance here in Quebec, my insurance company pays for my damage and his insurance pays his damage. I won't have to pay my deductible, because I wasn't at fault. He will have to pay his deductible.

If the damage to the car is more expensive than the book value of the car, I will be paid the book value of the car. If the repairs are less expensive than the book value, the insurance company will pay the repair place (in this case, the Volvo dealership) for the repairs. The insurance company will also be billed directly by the rental car company for my "replacement vehicle".

Maybe. I'll have to go to the police station in town (~20 km from here) and ask. I got a card from the cops, but I can't find it :(
